Terms of sale

Draft — to be completed by DataGarden before payments go live. Text in [brackets] is a placeholder for a decision or wording that is not final.

These terms apply when you buy access to a Geo Sales market on The DataGarden. [Who the seller is: company name, registered address, company registration number, VAT number.]

1. What you buy

You buy access, in your own account, to one market (for example Bicycle Market) in the countries you choose. Access means you can see that market's shops in those countries in Geo Sales; what a purchase includes is listed per market on the coverage page. One order covers one market; another market is another order.

[What you may and may not do with the data: own business use, sharing within your organisation, no resale or redistribution of the data itself — to be written.]

2. Access period

Each country you buy gives 12 months of access from the moment your payment is received. Access does not renew by itself: to continue, you buy the country again.

When your access to a country ends within the next 60 days, you can renew it before it ends. The new 12 months then start when your current access ends, so no days are lost. A country you add to a market you already have gets its own 12 months, at the full yearly price.

[What happens if your account is closed during the access period — to be written.]

3. Prices and VAT

Prices are per country, per year, in euros, and exclude VAT. They are shown once you are signed in.

VAT is calculated at checkout by our payment provider, Stripe (Stripe Tax), from your billing address. If you give a valid EU VAT number from another EU country than ours, no VAT is charged and the reverse-charge rule applies. [Confirm the VAT wording, and which countries are served, with the tax adviser.]

The price you pay is the price shown when you started checkout. [Price changes for later purchases — to be written.]

4. Payment

You pay on Stripe's secure payment page; your card details never reach us. You can pay by card (with 3-D Secure where your bank asks for it), iDEAL or Bancontact. A bank payment such as iDEAL or Bancontact can take a moment to be confirmed; your access starts when it is.

[If a payment is reversed or charged back — to be written.]

5. Invoices

Stripe e-mails a receipt and an invoice to the address you enter at checkout. Your orders, with their invoices, are also listed under Transactions in your account, where you can update your billing details.

[Invoice details required by law, and how to ask for a corrected invoice — to be written.]

6. Cancellation and refunds

[To be decided: whether a purchase can be cancelled, within what period, whether and how refunds are made, and how the statutory right of withdrawal applies to business and to consumer buyers.]

If a purchase is refunded in full, the access it gave ends.

7. Free preview regions

Each market has one preview region that every account can explore in full, free of charge and without an end date. The preview region is shown per market on the coverage page.

[Whether DataGarden may change or withdraw a preview region — to be written.]

8. Changes to the data

[The shops, brands and figures come from public and third-party sources and change over time. What DataGarden commits to about completeness, accuracy and updates, and what happens if a source stops — to be written.]

9. Liability

[Legal.]

10. Contact

Questions about an order: write to hello@the-datagarden.io and mention your order number (it starts with DG-).

[Postal address; governing law and competent court — to be written.]

[Version and date of these terms.]
